The invoice was issued to me personally. Can I still submit it to my employer for reimbursement?
Principle 1: Reimbursement is possible, but…
In principle, an employer may reimburse the cost of safety footwear purchased privately by an employee. This is particularly common where the employer is obliged to provide protective workwear (e.g. under the Occupational Safety and Health Act or accident prevention regulations).
2. Conditions for a tax-free reimbursement
For the reimbursement to remain exempt from tax and social security contributions, the following conditions must be met:
- Necessity: The shoes must be necessary for the employee’s work (e.g. a legal requirement at the workplace).
- Evidence: The employee must provide the employer with an invoice (which may be in the employee’s own name) and evidence that the shoes are actually used at work.
- No monetary benefit: The reimbursement must not be regarded as additional wages, but must be made in the overriding interests of the business.
3. Accounting treatment
- Financial accounting: The reimbursement is recorded as an expense for protective workwear, not as a wage payment.
- Payroll accounting: There is no obligation to deduct income tax or social security contributions if the conditions (see above) are met.
4. Practical implementation
- The individual submits the invoice to the employer.
- The employer checks that the expenditure is necessary and pays the amount upon presentation of proof.
- It is not strictly necessary to amend the invoice (to make the employer the recipient), but this may be relevant for the employer in terms of input VAT deduction (if the employer is entitled to claim input VAT deduction).
5. Important notes
- Input tax deduction: In principle, the employer cannot deduct input tax from an invoice issued in the employee’s name. For input tax deduction, the invoice must be made out to the employer.
- Documentation: An internal instruction or a reimbursement form should be documented.
Conclusion
Reimbursement is, in principle, possible and tax-free if the shoes are necessary for business purposes and the payment is made in the employer’s overriding interest. For input tax deduction, an invoice made out to the employer would be advisable, but for a simple reimbursement of costs, a private invoice is sufficient.
